21 August, Kathmandu. Constitutionalist Dr. Bipin Adhikari said that the right to appoint judges should be given to the Chief Justice.
Speaking at a seminar on 'Reconsideration, Timely Reform of the Constitution' organized in Lalitpur on Sunday, he said that the powers from appointment of judges to disciplinary action should be given to the Chief Justice for the reform of the judiciary.
He said that the problem of the Judicial Council is not the Council but the role of the Chief Justice who leads it.
In the Judiciary, if the assertive role of the Chief Justice in the Judicial Council is to be maintained, then it is possible that the court will be reformed within two to four months. First of all, that law should be amended," he said, "the Chief Justice should be appointed as a whole, all powers from judges to disciplinary actions should be given to the Chief Justice. Because he has to take the responsibility of the court. He may be impeached in the House. He is also a responsible person and public face.
He emphasized that the Supreme Court should be transformed into a constitutional court for the structural reform of the courts and the provincial courts should be equipped with the same capacity, competence and resources as the Supreme Court. If that is done, the pressure of cases in the Supreme Court will be reduced and other problems will also be solved, he said.
